AMERICAN LINE GEAR TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of the American Line Gear website, online store, products, content, and related services collectively referred to as the “Services.”

Throughout these Terms, “American Line Gear,” “we,” “us,” and “our” refer to American Line Gear. “You,” “your,” “customer,” and “buyer” refer to any person or organization accessing the Services or purchasing our products.

By visiting our website, creating an account, placing an order, or otherwise using the Services, you agree to these Terms and our applicable policies, including our Return Policy and Privacy Policy.

If you do not agree to these Terms, you may not access or use the Services.

1. ELIGIBILITY

You must be at least 18 years old or the age of legal majority in your jurisdiction to make a purchase through our website.

By using the Services, you represent that:

• You have the legal authority to agree to these Terms
• The information you provide is accurate and complete
• You will use the Services and our products only for lawful purposes
• If purchasing on behalf of a business or organization, you are authorized to bind that business or organization to these Terms

We reserve the right to refuse service, cancel orders, or restrict access to the Services when permitted by law.

2. ACCOUNT INFORMATION

You are responsible for maintaining the confidentiality of your login information and for all activity occurring through your account. You agree to notify American Line Gear promptly if you believe your account has been accessed or used without authorization.

You are responsible for ensuring that your contact, billing, and shipping information remains accurate and current.

We are not responsible for losses caused by inaccurate information provided by the customer or by unauthorized account access resulting from the customer’s failure to protect their login credentials.

3. PRODUCT INFORMATION

We make reasonable efforts to display product descriptions, specifications, colors, measurements, photographs, pricing, and availability accurately. However, we do not guarantee that all website information will be complete, current, or error-free.

Colors and product appearance may vary depending on lighting, photography, production materials, manufacturing updates, and the device or screen used to view the product.

Measurements and weights may be approximate unless expressly stated otherwise.

We may update, improve, modify, or discontinue a product without notice. Updated products may differ slightly from photographs, descriptions, or previous versions while maintaining substantially similar functionality.

Product images are provided for reference and may include accessories, tools, equipment, or background items that are not included with the product unless specifically stated.

4. PRODUCT USE

American Line Gear products must be used only for their intended purposes and in accordance with all supplied instructions, warnings, labels, and applicable industry practices.

The buyer is responsible for:

• Selecting a product appropriate for the intended application
• Inspecting the product before each use
• Using the product properly
• Following all supplied instructions and warnings
• Complying with applicable workplace requirements and regulations
• Properly maintaining, cleaning, and storing the product
• Removing damaged, worn, or unsuitable products from service

Do not use a product that appears damaged, defective, altered, excessively worn, or unsuitable for its intended purpose.

American Line Gear is not responsible for injury, property damage, loss, or other consequences resulting from misuse, improper installation, unauthorized modification, improper maintenance, failure to inspect, use beyond the product’s intended purpose, or failure to follow instructions and warnings.

5. ORDERS

Your submission of an order is an offer to purchase the products listed in the order. An order is not accepted until American Line Gear confirms acceptance or ships the product.

An automated order-confirmation email acknowledges receipt of your order but does not necessarily constitute final acceptance.

We reserve the right to:

• Accept or reject any order
• Limit order quantities
• Restrict sales to certain individuals, businesses, regions, or jurisdictions
• Cancel orders involving pricing, inventory, payment, or website errors
• Cancel orders suspected of fraud, unauthorized resale, or misuse
• Request additional information before accepting or shipping an order

If we cancel an order after payment has been collected, we will issue a refund for the canceled portion to the original payment method.

6. PRICING AND AVAILABILITY

All prices are displayed in U.S. dollars unless otherwise stated.

Prices, promotions, product availability, and specifications may change without notice. A product placed in a shopping cart is not reserved and may become unavailable before checkout is completed.

We reserve the right to correct pricing, description, inventory, discount, or calculation errors. If an error affects an order, we may contact you for instructions or cancel the affected order and issue an appropriate refund.

Promotional pricing, discount codes, and special offers:

• Are valid only during the stated promotional period
• May be limited to specific products or customers
• Cannot be combined unless expressly permitted
• Have no cash value
• May not be applied to previous purchases
• May be modified or discontinued where permitted by law

7. PAYMENT

You agree to provide current, complete, and accurate billing and payment information.

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize American Line Gear and its payment providers to charge the total amount shown at checkout.

The amount charged may include:

• Product prices
• Shipping and handling
• Applicable taxes
• Customs duties or import charges when applicable
• Other charges disclosed before checkout is completed

Orders may be delayed or canceled if payment cannot be authorized, verified, or completed.

8. TAXES

Applicable sales tax will be calculated based on the order, products, shipping destination, and legal requirements in effect at the time of purchase.

Customers purchasing on behalf of a tax-exempt organization must provide valid documentation before placing an order if they wish to claim an exemption. Tax refunds are not guaranteed when exemption documents are provided after an order has been completed.

International buyers are responsible for applicable duties, tariffs, brokerage fees, import taxes, and other charges imposed by the destination country.

9. SHIPPING AND DELIVERY

Shipping and delivery estimates are provided for convenience and are not guaranteed unless expressly stated in writing.

Delivery may be affected by carrier delays, weather, natural disasters, labor disruptions, incorrect addresses, supply issues, or other circumstances outside our reasonable control.

The buyer is responsible for providing a complete and accurate delivery address. Additional costs resulting from an incorrect address, refused delivery, failed delivery attempts, or failure to collect a shipment may be charged to the buyer or deducted from any available refund.

The buyer must inspect delivered packages promptly and report damaged, defective, incomplete, or incorrect orders to Crew@americanlinegear.com within five calendar days of delivery.

American Line Gear is not responsible for delivery delays or losses caused by events outside our reasonable control, subject to applicable law.

10. RETURNS AND EXCHANGES

Returns and exchanges are governed by the American Line Gear Return Policy in effect at the time of purchase.

Unless otherwise stated in that policy:

• Returns require prior authorization
• Products must be unused and meet all eligibility requirements
• The buyer is responsible for all return-shipping costs
• Original shipping and handling charges are nonrefundable
• Returned products are subject to inspection
• Refunds may be reduced by applicable restocking fees or other authorized deductions
• Unauthorized or ineligible returns may be refused

Review the complete Return Policy before making a purchase.

11. WARRANTY CLAIMS

Product warranties, when offered, are governed by the written warranty applicable to the specific product.

A warranty applies only to the extent expressly stated. Unless prohibited by law, warranties do not cover:

• Normal wear
• Cosmetic damage that does not affect function
• Misuse or abuse
• Accidents
• Improper installation, storage, cleaning, or maintenance
• Unauthorized modifications or repairs
• Failure to follow instructions or warnings
• Damage caused by chemicals, heat, fire, sharp objects, excessive force, or environmental exposure
• Use outside the product’s intended purpose

Submitting a warranty claim does not guarantee repair, replacement, credit, or refund. American Line Gear may require photographs, proof of purchase, return of the product, or other information before completing an evaluation.

12. PURCHASES FROM AUTHORIZED DISTRIBUTORS

Products purchased through an authorized American Line Gear distributor are subject to that seller’s payment, shipping, return, and exchange policies.

Refunds must generally be requested from the business that processed the original payment. American Line Gear cannot issue a direct refund for a transaction completed by another seller.

Applicable American Line Gear product warranties may remain available subject to their stated terms and proof-of-purchase requirements.

13. PROHIBITED USES

You may not use the Services:

• For unlawful, fraudulent, deceptive, or malicious purposes
• To violate any applicable law or regulation
• To infringe intellectual-property or privacy rights
• To submit false or misleading information
• To impersonate another person or organization
• To distribute malware, viruses, or harmful code
• To interfere with the operation or security of the Services
• To collect information about other users without authorization
• To gain unauthorized access to accounts, systems, or networks
• To scrape, copy, reproduce, or commercially exploit website content without written permission
• To conduct fraudulent chargebacks or payment disputes
• To purchase products for unauthorized resale
• To misuse discounts, promotions, dealer pricing, or customer accounts

We may suspend or terminate access to the Services for violations of these Terms.

14. INTELLECTUAL PROPERTY

The Services and their contents—including product names, logos, trademarks, designs, photographs, videos, graphics, text, packaging, website layouts, and other materials—are owned by or licensed to American Line Gear and are protected by applicable intellectual-property laws.

Access to the Services does not transfer any ownership or intellectual-property rights to you.

You may view and use website content for personal, noncommercial shopping and informational purposes. You may not reproduce, modify, distribute, sell, publish, display, create derivative works from, or commercially use our content without prior written permission.

“American Line Gear,” associated logos, product names, slogans, and brand elements may not be used without our written authorization.

15. REVIEWS, PHOTOGRAPHS, AND USER CONTENT

If you submit a review, photograph, video, comment, testimonial, suggestion, or other content to American Line Gear, you represent that:

• You own the content or have permission to submit it
• The content is accurate and lawful
• The content does not violate another party’s rights
• The content does not contain harmful, defamatory, obscene, fraudulent, or misleading material

You grant American Line Gear a nonexclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, publish, display, distribute, and promote submitted content in connection with our business and marketing.

You retain ownership of your original content. Where required by law, this license is subject to any rights that cannot legally be waived.

We may remove or decline to publish user content at our discretion, but we are not obligated to monitor every submission.

16. THIRD-PARTY SERVICES AND LINKS

Our website may use or link to third-party services, including payment processors, shipping carriers, social-media platforms, analytics providers, and other websites.

American Line Gear does not control and is not responsible for third-party websites, services, content, privacy practices, availability, or security.

Your use of third-party services may be subject to separate terms and policies issued by those providers.

By using the Services, you acknowledge that information may be processed by service providers necessary to operate our website, process payments, fulfill orders, provide customer service, prevent fraud, and perform other legitimate business functions.

We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free.

We may modify, suspend, restrict, or discontinue any portion of the Services at any time. We are not liable for interruptions, delays, technical problems, data loss, or unavailability caused by maintenance, system failures, third parties, or events outside our reasonable control.

19. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the Services and website content are provided on an “as is” and “as available” basis.

Except for any express written product warranty, American Line Gear disclaims all warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, these exclusions apply only to the maximum extent permitted by law.

20. LIMITATION OF LIABILITY

To the fullest extent permitted by law, American Line Gear and its owners, employees, officers, contractors, affiliates, licensors, suppliers, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost revenue, lost data, lost business, or loss of goodwill arising from or related to:

• Your use of or inability to use the Services
• Your purchase, possession, installation, or use of a product
• Product misuse, modification, or improper maintenance
• Website errors or interruptions
• Third-party conduct or services
• Unauthorized access to an account
• Delayed, lost, or damaged shipments
• Reliance on website content

To the fullest extent permitted by law, American Line Gear’s total liability arising from a particular order or product will not exceed the amount you paid directly to American Line Gear for the product giving rise to the claim.

These limitations do not apply to liability that cannot legally be limited or excluded.

21. INDEMNIFICATION

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless American Line Gear and its owners, employees, officers, contractors, affiliates, suppliers, and service providers from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorney fees, arising from or related to:

• Your violation of these Terms
• Your unlawful or unauthorized use of the Services
• Your misuse, alteration, resale, or improper installation of a product
• Your violation of another party’s rights
• Content you submit through the Services

This section does not require you to indemnify American Line Gear for conduct for which indemnification cannot legally be required.

22. GOVERNING LAW AND VENUE

These Terms and any dispute arising from the Services or products will be governed by the laws of the State of Washington, without regard to conflict-of-law principles.

Unless applicable law requires otherwise, legal proceedings relating to these Terms or the Services must be brought in a state or federal court having jurisdiction in Clark County, Washington. You consent to the personal jurisdiction and venue of those courts.

23. CHANGES TO THESE TERMS

We may update these Terms periodically to reflect changes to our Services, products, business practices, or legal obligations.

Updated Terms will be posted on our website with a revised effective date. Changes will apply prospectively unless applicable law permits or requires otherwise.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.

24. TERMINATION

We may suspend or terminate your account or access to the Services if you violate these Terms, create risk or potential legal exposure, engage in fraudulent activity, or misuse the Services.

The provisions that by their nature should survive termination will remain in effect, including provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution.

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision in the future.

27. ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written permission.

American Line Gear may assign its rights and obligations in connection with a merger, acquisition, sale of assets, corporate reorganization, or transfer of the business, subject to applicable law.

28. ENTIRE AGREEMENT

These Terms, together with our Return Policy, Privacy Policy, applicable product warranties, and any other policies referenced herein, constitute the complete agreement between you and American Line Gear concerning the Services.

If a product-specific written agreement conflicts with these general Terms, the product-specific agreement will control for that product to the extent of the conflict.
